Common-Law Husband or Wife is not a recognised legal status for a couple living together for a long period of time. The UK Law regards a couple living together as cohabitation. Cohabitation agreements are becoming increasingly popular as more couples choose to live together without formalising their partnership through marriage, as it helps to protect both individual’s income and assets should the relationship result in separation.

There is no separate statutory code governing the breakdown of the relationship of co-habiting couples. Unlike divorcing spouses, cohabitees must turn to complex and sometimes archaic principles of property, trust and contract law. Difficult issues can arise on the death of one of the parties.
